Trump’s Potential AG Asks for Pardon List From Jan. 6 Sympathizer

Conservative attorney Mike Davis, potential contender for President-elect Donald Trump’s attorney general post, is seeking a list of those convicted in the January 6, 2021, attack on the U.S. Capitol.

Davis made the request in a post to X on Thursday, asking fellow conservative lawyer Julie Kelly for her “pardon and commutation lists.” Kelly describes herself as a “January 6 conspiracy theorist” and “insurrection denier.”

Davis also requested Kelly’s “list of the bad actors in the Biden-Harris Justice Department.”

Both attorneys have been highly critical of the legal perils against Trump, who was elected to a second term in the White House this week. Davis has previously suggested he would take “severe” legal action against special counsel Jack Smith, who is leading both federal criminal investigations against Trump.

Davis issued a threat to New York Attorney General Letitia James while speaking on The Benny Show on Thursday, saying, “We’re not messing around this time and we will put your fat a** in prison for conspiracy against rights.” James’ office won a civil case against Trump and his family business this year after a judge found that the former president and others associated with the Trump Organization were liable for misleading lenders and insurers for better terms.

Trump campaigned on the promise of pardoning at least some of the several hundred defendants found guilty of participating in the January 6 attack. On Thursday, a spokesperson for the president-elect’s transition team told Newsweek via email that Trump “will make pardon decisions on a case-by-case basis.”

Davis said on Thursday that the next Justice Department under Trump must end prosecutions for January 6 defendants, which he described as “political persecutions.”

It’s unclear if Davis, who is one of Trump’s attorneys, will serve in the new administration. He has been praised, however, by several people close to the former president. In an interview with Politico Magazine published in September, Donald Trump Jr. called Davis “the tip of the spear defending my father from these corrupt Democrat prosecutors. He’s exactly the type of fighter that I’d like to see involved in a second Trump administration.”

Davis’ rhetoric has also gotten plenty of attention. During an appearance on The Benny Show last year, he described a “three-week reign of terror” that he would carry out as Trump’s “acting attorney general before I get chased out of town with my Trump pardon.”

On Wednesday, he posted to X that his “current mood” was that he wanted to “drag their dead political bodies through the streets, burn them, and throw them off the wall. (Legally, politically, and financially, of course.)”

Other names touted as a potential Trump attorney general pick include Missouri Senator Eric Schmitt, who served as his state’s attorney general before being elected to Congress in 2023. Utah Senator Mike Lee, another close congressional ally to Trump, is also rumored to be on the list.

Jeff Clark, Trump’s former assistant attorney general, has also been floated as a potential choice. Clark had his law license suspended for two years for his role in pressuring the Justice Department to prevent the transfer of power amid the aftermath of the 2020 election. He was also indicted alongside Trump and several others in Georgia, accused of attempting to overturn the state’s election results in 2020.
